Gallery Paramhamsa provides an Authenticity Certificate for every artwork on its site on behalf of the seller that each piece of art on the site is a genuine work of the artist.
Gallery Paramhamsa guarantees the authenticity of the artwork for one year. Authenticity
implies compliance of the painting with the description provided on the website, particularly with reference to the name of the artist, title
(if any) of the painting, date, the School of Art to which it
belongs, dimensions, medium, et al..
If a painting is found to be counterfeit, Gallery Paramhamsa will
be entitled to rescind the sale of paintings by the artist and the
seller will be liable to refund price of the painting to the buyer
once the buyer returns the item to Gallery which shall then return
the artwork to its seller.
All such claims will be handled on a case-by-case basis. In case of an authenticity claim
substantial proof provided by an established and acknowledged
authority has to be furnished by the buyer to demonstrate that the
item is not authentic. The decision of Gallery Paramhamsa with respect
to such claims shall be final and binding.
This guarantee shall be subject to the following conditions:
1. The claim is made by the buyer as registered with Gallery Paramhamsa (the benefit of the claim is not assignable to any subsequent owners or others who may acquire or have an interest in any of the
paintings).
2. The painting is returned in the same condition as it was at the time of
its delivery.
3. To make sure that the painting was indisputably purchased through Gallery Paramhamsa.
In case of such fraudulences, Gallery Paramhamsa will enjoy the
right to consult two recognised experts in the field of painting
after getting the buyer's approval. These experts will examine the
painting under question to check its authenticity, only after
which the Gallery will move onto the next step of rescinding the sale
of the painting and also offer refund to the seller under the above guarantee.
If the seller fails to refund the proceeds as stated above, the buyer shall
authorise the Gallery to initiate legal proceedings against the
accused. The cost of the legal proceedings will have to be borne
by the buyer.
